POV - Litigation Support
Litigation Support encompasses several areas:
Digital Investigation and Diligence: I am often called on to support counsel in uncovering anonymous purveyors of online information on Wikipedia, Twitter, comments attached to web stories, and anonymously published blogs. I am experienced in drafting subpoena language with counsel, and defining paths that will get the best production in the shortest amount of time. I am also experienced in working with counsel, private investigators, and law enforcement in uncovering the source of threats, identity theft, digital intrusion and bootlegging.
Litigation Sentiment Assessment and Monitoring: Using a variety of proprietary and public toolsets to monitor attitudes about my client's litigation (on defense or offense, criminal or civil), I am able to provide advisors with report digests which are used to shape public messaging.
Public Advocacy: I create advocacy efforts designed to provide information to the public and help them find their own opinion, often when media is only reporting one side of complex criminal or civil issues. In some cases these have persuaded elected prosecutors that their action against my client was being widely perceived as unfair or vindictive, and have helped shape dismissals or plea agreements.
Copyright Support: When called upon to locate instances of the illegal distribution of copyrighted material, I trace the source of the distribution. These efforts have resulted in successful prosecutions, and the termination of the distribution channel.
